A man who was previously deemed unfit to stand trial has pleaded guilty in a 2014 Chili Avenue triple homicide, the Monroe County District Attorney's Office announced Wednesday.

Marlando Allen, 40, the trigger man in the slayings, pleaded guilty to three counts of second-degree murder in the Feb. 22, 2014 execution-style shooting deaths inside an apartment at 809 Chili Ave.

On March 2020, Allen, a citizen of Jamaica, was declared competent to stand trial by the state Office of Mental Health, prosecutors said. He will be sentenced to 15 years to life in state prison and will be eligible for possible deportation at the end of his term.

There had been significant disagreement among experts who examined Allen over the years, court records showed.

One doctor said that Allen suffers from schizophrenia and may show signs of brain damage. Another doctor testified that Allen was "malingering" and exaggerating or fabricating his symptoms. 

Jermiliah Simmons, 21, her cousin Jaqueline Simmons, 24, and their friend Michael Nelson, 24, were all shot in the head with the same 9mm handgun. Prosecutors said one of the victims was suspected of stealing marijuana from a local drug ring and was killed in retaliation.

Andre "Beanie" McFarlane and Steven Fulcott were also charged in the slaying. Fulcott was acquitted on the murder charges but was convicted of criminal possession of marijuana.

A day before he was scheduled to go on trial, in January 2016, McFarlane, the leader of the marijuana distribution organization, pleaded guilty to three counts of second-degree murder.

During his testimony, McFarlane told jurors he did not orchestrate the hit, but he OK'd the hit. He said he gave Fulcott and Allen the gun used in the shooting.

Each victim was shot multiple times (they were found by family members two days later). They were killed because one of them, Jermiliah Simmons, was paid by McFarlane to accept shipments of marijuana but instead secretly kept some of it for herself, according to court papers.

McFarlane, Fulcott and Allen all lived at 2167 Clifford Ave., Apt. 7, one of two apartments in that building where prosecutors allege the marijuana operation took place and where a search warrant was executed on Feb. 28, 2014.

A raid of the location found roughly 80 pounds of marijuana, a large amount of cash, and a variety of firearms, including the murder weapon.  

“This community will always remember the Chili Avenue triple homicide," Assistant District Attorney Robin Catalano said in a release. "Mr. Allen’s admission of guilt can finally give the family and friends of Michael Nelson, Jaqueline Simmons and Jermeliah Simmons peace.”

Allen is scheduled to be sentenced on Nov. 19, 2020, by County Court Judge Vincent Dinolfo.
