JACKSON, MI -- An attorney for a man charged in a triple slaying requested -- and received -- an adjournment in the murder cases due to the “magnitude” of the evidence they are still receiving.
Defense counsel for Zacharie Scott Borton met with prosecutors on Sept. 3 for a scheduled probable cause conference before Jackson County District Judge Joseph Filip. Borton himself did not appear in court.
Borton, 43, is accused of shooting and killing Delmar Eugene Fraley, 80; Edward John Kantzler, 70; and Michael George Pauli, 70. Police say the three men were found dead from apparent gunshot wounds on the morning Aug. 22 at a home in rural Grass Lake Township.

Leonard Ballard, Borton’s defense attorney, requested the tentative date for a preliminary examination be pushed back, saying that evidence is still being received even more than a week after Borton was arrested.
Assistant Jackson County Prosecutor Meaghan McKeon agreed with Ballard’s request to allow more time for discovery to take place.
Ballard said that as of Sept. 3, his office has only received basis law enforcement reports pertaining to the incident, as well as preliminary autopsy photos.
Filip did not outright deny the request to push back the exam date, but did not approve of an official rescheduling, saying the case is “important” to Jackson County, and there is a need for proceedings to continue moving forward.
Both parties are set to appear before Filip again on Sept. 10 to “check up” on the status of the case, Filip said.
Borton was arraigned Tuesday, Aug. 24 on three counts of open murder, car theft, unauthorized use of a credit card and second offense of felon in possession of a firearm in connection with the recent triple homicide. Prosecutors stated during Borton’s arraignment the murder charges are backed up by cell phone tracking and photographic evidence collected at the scene.
Borton was staying at the home of the fatal shooting and was believed to have fled the scene in a vehicle owned by one of the victims, police said. The vehicle was recovered, along with several guns, according to the Jackson County Sheriff’s Office.
Police have not released any additional information about the homicides.
Borton is being held without bond in the Jackson County Jail.
