Some Dallas County evictions on hold until June 15 - The Dallas Morning News

Dallas County justices of the peace issued a unanimous moratorium this week to halt some eviction proceedings until June 15.

The moratorium applies to eviction proceedings filed after March 27 and comes after the Texas Supreme Court’s moratorium expired Tuesday.

Justice of the Peace Sasha Moreno, whose court is in Grand Prairie, said June 15 is the earliest Dallas County justices will hear those eviction cases.

Some justices of the peace, Moreno said, have been conducting eviction hearings filed before March 27 by phone or teleconference. But she added that her court will hold off until June 15, when courts are set to reopen, to hear them in person.

“It’s not a delay and we’re not favoring one side or another,” Moreno said. “Not all people have access to these resources and so the fairest option is to let them come to court.”

The expiration of the Texas-wide moratorium will allow landlords to post notices of eviction and actual removals to resume Tuesday.

Many area residents have been hit hard financially by the COVID-19 pandemic as industry sectors across the board shut down due to state and county orders limiting what kinds of businesses and establishments could remain open.

As of mid-May, some 2.3 million Texans had applied for unemployment benefits, according to the Texas Workforce Commission.

Moreno said it doesn’t make sense to resume evictions in Dallas County given the daily increase of coronavirus cases and people being out of work.

Some protection remains for city of Dallas residents in the form of a recently adopted ordinance that allows renters time to catch up on rent if they lost income or their jobs due to COVID-19 business closures.

Moreno said courts will also need to do some catching up as there are eviction hearings pending from before courts closed earlier in the pandemic. She added that she expects to see an increase in eviction filings once courts reopen.

Dallas County’s moratorium on evictions was originally set to expire May 18.

County Judge Clay Jenkins signaled support for the move late Wednesday night.

“We can’t afford more homelessness and couch surfing during substantial community spread of a once in a century global pandemic to which residents have no immunity,” Jenkins tweeted.
